A. Termination
These Terms and Conditions govern your use of the PCT Outdoor Living website at pctoutdoorliving.com and any construction or contracting services we provide (collectively, the "Services"). By using our website or engaging our Services, you agree to these Terms.
1. Services Offered
PCT Outdoor Living LLC provides residential outdoor construction services throughout South Jersey, including deck design and installation (composite, vinyl, custom, and pool decks), hardscaping (patios, walkways, retaining walls, and pavers), fence installation (metal, vinyl, and pool-compliant fencing), and related site preparation and finishing work. We reserve the right to decline any project at our sole discretion.
2. Estimates & Quotes
All estimates — whether verbal, written, or submitted through our website — are non-binding and subject to change until a written project contract is signed by both parties. Estimates are based on conditions known at the time of assessment. Unforeseen site conditions, material price changes, or scope additions may result in revised pricing, which will be communicated before work proceeds. Free estimates do not create any obligation on either party to enter into a contract.
3. Project Contracts
All construction work is governed by a separate written project contract specifying scope of work, total cost, payment schedule, timeline, material selections, and warranty terms. In the event of a conflict between these Terms and a signed project contract, the signed contract shall control for that specific project.
4. Payment Terms
A deposit is required to schedule and begin work. Progress payments may be required at milestones as outlined in the project contract. Final payment is due upon project completion and client walkthrough. Payments more than 10 days past due may be subject to a late fee of 1.5% per month on the outstanding balance. We reserve the right to suspend work where payment is overdue. All prices are in U.S. Dollars.
5. Permits & Code Compliance
Where required, PCT Outdoor Living will obtain necessary permits on your behalf; permit fees will be included in the estimate or billed as a pass-through. You are responsible for disclosing accurate property lines, site access conditions, and any HOA restrictions, easements, or deed covenants that may affect the project. We are not responsible for delays caused by municipal permitting offices or third-party inspections.
6. Changes & Modifications
Any changes to the approved scope of work must be requested and approved in writing via a signed change order. Verbal approvals are not binding. Change orders may result in additional costs and timeline adjustments. We will provide a written estimate for your approval before performing any out-of-scope work, except where immediate action is required to prevent property damage or a safety risk.
7. Warranty
PCT Outdoor Living warrants all labor and workmanship against defects for the period specified in your project contract and detailed at pctoutdoorliving.com/warranty. This warranty does not cover normal wear and tear, weathering, damage caused by misuse or neglect, acts of nature, work modified by third parties after project completion, or manufacturer defects in materials. Materials may carry separate manufacturer warranties, which will be passed through to you where applicable.
8. Limitation of Liability
To the fullest extent permitted by law, PCT Outdoor Living's total liability for any claim arising from our Services shall not exceed the total amount paid by you for the specific project giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including loss of use, loss of revenue, or property damage beyond the scope of our direct work. PCT Outdoor Living carries general liability and workers' compensation insurance as required by New Jersey law. A certificate of insurance is available upon request.
9. Website Use
Our website is provided for informational purposes. You agree to use it only for lawful purposes, not to interfere with or attempt to hack the site, not to use automated tools to scrape content without written consent, and to provide accurate information when submitting forms. We reserve the right to modify or discontinue any part of the website at any time.
10. Intellectual Property
All website content — including text, images, logos, project photography, and design elements — is the property of PCT Outdoor Living LLC or its licensors and is protected by copyright and trademark law. You may not reproduce or use our content for commercial purposes without prior written consent. Project designs and drawings remain our intellectual property until full payment has been received.
11. Dispute Resolution
In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If unresolved within 30 days, either party may pursue mediation through a mutually agreed-upon mediator in Gloucester or Camden County, New Jersey. Nothing in this section limits either party's right to seek emergency injunctive relief in a court of competent jurisdiction.
12. Governing Law
These Terms are governed by the laws of the State of New Jersey. Any legal action shall be brought exclusively in the state or federal courts located in Gloucester County, New Jersey.
13. Changes to These Terms
We may update these Terms at any time. Changes are effective upon posting with a revised effective date. Continued use of our website or Services constitutes acceptance of the updated Terms. Changes to these Terms will not affect the terms of any existing signed project contract.
